  • I94 expired but need to renew EAD

Hey guys, so I am a USC spouse, I applied for parole in place because my spouse is active duty and was approved but expired in February 2019. I need to renewal my EAD card since my I485 is still pending for interview since May 2018. For my i765 application to renew EAD I dnt know what to put down for my current status. And do I have to pay the filling fee is my i485 is pending? Please help.

From what I read you don't have to pay a fee, you must include a copy of your pending I485. I can't find the answer on what to put on your status, I don't know if it's AOS or 'Pending I485', hope someone else can help with that. Good luck.

I think you should use the "C9" category. That one is used when you have a pending I485 process. I renewed mine last December and that is my new category.

For status you can put something like "Parolee (expired)". Status doesn't matter for AOS-based EADs.

This is my personal opinion and is not to be construed as legal advice.
