  • Am I totally screwed???

    I am writing right now extremely stressed out! I got an RFE letter on Monday to show my husband’s pay stubs for a job he started in April! BUT!!!! As of yesterday, he stopped working there!!! I am totally freaking out!!! So right now he has no job! I do have joint sponsor though, but what do I do now regarding responding the RFE??? Do I need to write a letter explaning my husband doesn’t work there anymore? Do I need to re-submit an updated I-864? Should we still send the paystubs from a job he no longer works in? Please guys, help me and tell me what to do. Am I completely screwed over here responding their RFE without what they want from me?

    At this point i’d probably consult with a lawyer to see what your options are. I know it’s already cost a lot of money but you don’t want to screw up or just rely on somebody else’s experience without any kind of professional advice. The consultations are usually about $100 and i think it’s money well spent. Plus they are usually willing to fit you in their schedule within a day or two or so. Some even do consultations over the phone to make it more convenient...

        It’s super stressful and hopefully there will eventually pop up someone who was in a similar situation (and who could give you some actual calming words) . In the meantime though, don’t overthink it. It’s got to have some kind of solution and that’s what the lawyers are for.

            I have seen cases with couples, where the petitioner is a student and is unemployed so they don't have any income. Your petitioner will probably have to redo the I864 and put "unemployed" with current income 0.00. Also for tax info on the I864 form, mention "Not Required to File" in I-864 and attach a written explanation stating minimum income.
            You have a Joint sponsor already where you should be fine. You just submit the Joint Sponsor's Tax return transcripts and the additional info such as retirement letters.

              Oh no!! That is terrible. You should be ok if your joint sponsor has enough income to sponsor you. You might need an updated i-864 and a letter explaining the change. Do take a consultation with a lawyer to respond to your RFE. A consultation is better to get the right legal advice on this and it won't be that expensive.

                    Save your money. Just submit the pay stubs. The question is very simple. Do you have pay stubs for April? If yes submit it. If not then it's another story. Don't stress out this much. It's a really simple process.

                      Also if needed you can still reachout to the previous place of work and request a paystub. They usually have ADP or some other software to which they can give you access as ex employee to get the paystubs.

                            Sort of, he works from home mostly. He works for a company and does work for them and sends invoices to them for whatever he has done and they pay him based on that.

                              Well you need proof of income. Invoices are not proof of income. What you need is proof that your husband earns an income - so you are going to need copies of checks or deposits made to him by that company.
