My PD is Sep 2008 , I140 approved.
My status details are below.
Primary applicant (X) : Current H1 expiring March 2013 , H1B visa stamped in passport
Dependent applicant (Y) : Current H1 expiring Sep 2013 , H1B visa stamped in passport
I had a chat with lawyerand he mentioned that since my & my wife’s current H1B visa doesn’t expire anytime soon , applying for AP and EAD along with our I-485 is not required as we have travel documents & work visa authorization already. And these applications come at an additional processing fee.
My question is : Assuming the worst case scenario where the PD for EB-2 India retrogresses back to sometime in 2008 (it has happened in the past ! ) , can I still file for EAD & AP at a later time providing proof of my receipt of my I485 application with USCIS ? Or in order to process my EAD/AP does my PD have to be current ?
