  • Removal of conditions for 2 year green card

Hello. My husband's greencard is expiring soon and we need to file for removal of conditions. We are kind of in an odd situation as we are currently overseas due to work and plan on staying here for at least another year. Can we still apply for a removal of his conditions? Or do we have to forfeit his entire greencard?

I-751 can be filed from abroad.

His length of absence is a separate issue. If he doesn't have a Re-entry Permit, he is normally supposed to return with his green card (or expired green card plus extension letter) within 1 year of departure. If he doesn't have a Re-entry Permit and is outside for more than 1 year, he would need to either get an SB-1 visa, or get to the port of entry somehow (boarding the flight with his green card or expired green card plus extension letter) and hope that the immigration officer will waive the requirement and let him in.

This is my personal opinion and is not to be construed as legal advice.
