  • deportation record

My friend was deported at the US border about 7 yrs ago due to insufficient document of his entry, but was informed no restriction of his re-entry. He re-enterd US 2yrs later with a B1 visa and a legally changed new name. His current status is H1, and is applying I-485 (family based) now.

    Questions:
•How long will his deportation record kept in INS computer system?
•How will it affect his I-485 application?

Thanks a bunch for you help!!

A deportation record is kept in the INS files indefinitely.

Since he was lawfully admitted with his H-1B, his prior deportation should not adversely effect his present adjustment of status application. If it should become an issue, he can apply for a waiver with the INS.

    Good luck to you.
