What is PTI and what is post conviction relief. Thanks on Advance!

  • #2
In the context you've used it, PTI likely refers to pre-trial intervention. The exact context of both of these actions will vary depending on whether charges are being faced at the federal level and also state to state. Pre-trial intervention is typically designed to avoid prosecution of non-violent, non-serious offenders to both ease the burden of trials faced by courts and to avoid bestowing a criminal record on the offender. Post conviction relief is typically filed by a defendant once their appeal has been denied by an appellate court. PCF is filed with the trial court if new evidence has arisen since the conviction.
*Always be truthful and as forthcoming with information as possible during visa/admission/adjudication interviews. If it is discovered that you have misrepresented yourself during processing the penalties can be severe.*
