  • travelling outside US after I-140 approved

    I-140 approved recently,
    6yrs of H1 will expire in 3 months,
    Employer not ready to file for extension, but willing to offer me to job in my home country

    my questions
    1. will my I-140 remain valid?
    2. can I change jobs after I go back?
    3. can I file I-485 when the priority date becomes current?

    Any help will be appreciated.

    1. Yes, as long as the job offer is still valid (the one after you get the greencard.)
    2. As long as you are willing to work for the employer who sponsored your greencard once you get greencard, you can do any other job meanwhile.
    3. You need to be in the U.S. to file I-485. If you are outside the U.S., you can go for immigrant visa (consular processing).
