  • L1A to GC with different employer..

    Hi,

I am on L1A with 2 years left before reaching 7 year cap. A different employer other than my current employer for whom I am working on L1A is willing to do my GC even before i join them. My question is suppose future employer file PERM for my GC now and I continue to work for my current employer. After 6.5 year on working for my current employer on L1A can my future employer hire me based on my PERM application status at that point of time. OR my future employer needs to hire me by doing h1b for me before I finish my 6 years and then keep renewing my H!b till GC is done. In other words can my future employer hire me after i spend around 7 years in US on L1A based on my GC application status at that point of time.

On what valid status is your future employer going to hire you after 6.5 years completion? Your future employer cant hire you based only on the PERM application.

You should have your future employer initiate the H1 much before you finish your 6th Year otherwise you would have to spend an entire year or more outside US in order to be eligible for fresh 6 Years H1. Also, understand that L1 +H1 continuous stay can only be for 6 Years.

This is my opinion not legal advice.
