I am with my current organization for 10+ years and an international manager who qualify all requirements laid down by USCIS for EB1 in terms of job description. I was on L1B before and got promoted to senior management role managing multi-million dollar portfolios in 2008. I had traveled outside US couple of times due to job requirements. Once my L1B was over, I got L1A and came back to US in May 2012. I have spent only 10 months outside US in the 3 preceding years before I came into US in May 2012. Hence I am two months short of the 1 year requirement. My understanding of 1 year USCIS requirement is to make sure whether the person has worked for the same company in same capacity outside US as well, to prove him as an International manager. Though I satisfy that, I am technically short of couple months. Will it be wise to apply in EB1?
