L1A to Green card with sufficient Offshore requirement
Hi,
I am a bit confused about the 365 days offshore requirement which is mandatory for a EB-1 filing.
1. I got promoted in India on Nov-10,2010 as a manager in India.
2. I traveled to US on Oct-10, 2011.
3. I applied my green card through on employer in Dec-2013 wherein it was mentioned that i would not qualify for EB-1.
Now, if my complete my remaining 30 of 365 days which were incomplete. Won't i be eligible for EB-1.
My employer is again asking me to go back to India for 1 year and than reenter. I am confused.
Can someone help?
