  • Tricky situation RFE, please help

    I received RFE last week for continuous eligibility etc....
    My PD is Apr 2009, I got EAD in 2012. Recently 3 months before(Apr 2014) I took full time position with a new employer, but did not file AC21 with a fear that job title, description changed and salary reduced.

    Details per i-140:
    Job title per i-140 : Senior software engineer,
    job description: Changed but mostly similar.
    Salary 85k
    Prevailing wage source : OES
    Skill level-III
    SOC/O net code: 15-1031.00

    Details per new employer (current):
    Job title: Quality test engineer
    Salary: 65k
    note: when I search prevailing wage source for Quality test engineer in the website it says : 65k belongs to level3 in my NY state, Monroe county.

    My question:
    Now I have Ac21 from new employer where they mentioned my job duties are similar to old employer, but still due to salary reduced from 85k to 65k, im worried of denial..

    So what are my options?:
    1: respond to RFE with new employer offer letter and Ac21 documentation??

    2: My old employer said he is ready to help me to give EVL from his company as he did not cancel the i-140 yet.

    If i go through my old employer, in case i ned to submit pay stubs for this 4 months what to do?
    is there anyway my old employer can support that?

    I sincerely request all of you to give me best advise?
    I am in lots fo confusion.
