GC situation - need advise!
Hi,
I'd like your advise on my situation. I am getting ready to file my I-485 and I was wondering if I should file for I-765 (EAD) and Advance Parole. My situation is as follows:
1. I have a valid H1B on my passport. The first 3 year term expires in Dec 2007. Hence I will have to renew for another 3 years
2. My wife changed from H4 to H1, but she does not have a H1 stamp on her passport (she only has H4 stamp)
3. We plan to go to India on vacation in Dec 2007 for a month.
Assuming that I file my I-485 now could anyone tell me
1. How long will I-485 take to process. Will it be done by Dec 2007?
2. Should I and/or my wife apply for EAD and AP? (I dont intend to change jobs, however if EAD and AP will not require my wife for stamping that would be ideal)
3. If the I-485 gets approved when I am in India (assuming we have AP), what will happen?
