petition/Application for Work Permit, SSS,ETC

I was petitioned by my american husband sometime in Dec. My . We got married in Oct 07. He wasn't aware of IRS ruling, he stated as single. in his Income Tax Return So, to be consistent, I filed as single also.
Would that have an impact on his pending petition to me and my application for work permit as well. .
Need your help on this. Do INS look on this filing status ?

You both should have filed as married filing seperately if not filing jointly. In general filing as single means that you pay less tax than married filing seperately.

File amended tax return to correct errors in it.
