Hi All,

subject : H1B Six Year Duration Calculation

I have got my I-797 issued from oct 2004 but my visa issued on feb 2005 and i stayed till July 2005 - 6 months.

Stayed out of the country for 7 Months.

then came back in feb 2006 and i am here till to date - 2yrs 5 months .

According to my calculation :

Feb 2005 - July 2005 - 6 months ( Came on the same H1B i have with the employer at that time and started working for him ) .
feb 2006 till date - 2yrs 5 months .

As per my assumption i have 3yrs one month remaining on my current H1B.

Can any one please advise is it correct that the seven months i stayed out of the country doesnt count under my Six year H1b duration . Advise please .

and advise the correct duration that is left on my H1B

Yes, it is correct. Only time spent on H1b status inside the US is counted. You can do the math based on it.

Thanks for the reply . Is there any process in place to claim these months that i am outside US . Suggest please .
