  • Denied Green Card and H1B

    Hi folks,

I have H1B visa (second year) and I haven't applied for an employment based green card yet.

Next year my H1B visa will expire. Let's say I apply for green card now and next year my application is still pending... Assume that something goes wrong and green card is denied right after my H1B expires. Then what happens to the rest of my H1B time? Can I apply for "Extension of Stay" through H1B after green card is denied?

You can remain on H1b if you have not completed your 6 years irrespective of what happens to GC if H1b is approved.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      Just in case ...

... if you GC application is rejected, you need to plan and consider appealing against that decision.

      Good luck.
