  • L1B beyond 5 years while I-140 approved

    Hi Friends,

I need your help to understand Green Card process for L1B holders.

As per my understanding I can stay maximum 5 years in US. In green card process, if I have approved I-140. Let say not applied for 485 due to PD.

    1. Can I able to apply visa L1B extension after completing 5 yrs stay.
    2. How many times I can extend and what would be validity period each extension.

    I appreciate your help

Not unless you have filed your 485 or have a H1b and a labor/140 for that filed for 365 days/approved.

Thanks a lot. Could you please clarify me.

          1. If I go for H1B for new employer. Can I still able to apply 485 with approved I140.
2.If I go back to India. Can apply 485 when PD current from India.
