    Hello Friends,

    I have critical question regarding the GC process.

    I am currently on H1B visa and have applied for Labor as a first step to GC.
    My employer has applied in EB2 category and based on the current processing time, I am expecting to finish the GC process in 4 years.

    Now, if after sometime (1-3 years) I plan to go back to home country (India) and want to come back when GC process is complete, then does it affect my GC process or I can simply come back to US by apearing the US consulate abroad.

    Please explain upto which step this can be done and what are the implications.

    As the greencard is for the future job that you will do for that employer who is sponsoring you, it is OK if you go out of the US while the processing is going on.

    However, it will be harder for both of you to prove that this arrangement is genuine if you are not working for the employer already.
