    Hello all,
    I have been working for this company for 3 years now. They are now applying for my GC. I have had 2 differnt job titled in the past 3 years and this next promottion is with a another job title with which the green card appl will be filed with.
    The lawyer says that i cannot show any of the 3 yrs of expe gained with this company and that i have to show only the expe i gained before joinin this company..I have never worked before joinin this cmpny and im worried how i am goign to stand a chance against all the epxrienced ppl...
    So has any one experienced this situation before ? Can u use expe gained from a cmpny where you are applying ur GC from???PLZ help!!!!!

    Unless the new job position is "substantially" (e.g. Engineer I, II, III.. to Project Manager) different and it can be demonstrated that roles and resposibilites of the GC position is really different from the ones you had in the past, it is not possible. This also requires competent HR and Lawyer in case of an audit.

        Sorry didnt read the response

        This is my story - I was in Quality as a Quality Mgr and now i have been promoted as process engr which typically reflects my education (BS and M) in chemical engr. But the management said they would wait and post the job with the title of a process engr so i could apply for it as if it was a new positions open withint he company. The job responsibilities are completely different from what ti used to be when i was in Quality. Shouldn't that be a good justification to use what i have learnt in this company for 3 years?

          The process engineer position might not require 3 yrs of quality experience. One cannot make the job description fit your experience. It works the other way around.

          It might have worked if you were promoted Sr. Quality Manager and this position required experience in Quality....and you had the required experience.
