  • H1B amendment for Job Title change

    Dear Friends,

    My current H1B is based on a Lead position which is valid for another two+ years. And my company wants to promote me to a new position titled Software Engineering Manager and my company wants to file for a H1B amendment for this. If for some reason the amendment gets rejected, will I still be able to continue my work on existing H1B and I-140? Please kindly let me know.

    Why would the amendment get rejected ?
    It's not just the title but job duties that matter as well. This combination is used to determine prevailing wage for LCA.
    If you possess the skills to do this job, and get paid at or above LCA, you should be good to go.

      Yes the Job responsibilities change to some extent along with Job Title. Its good to hear that amendment would gets through.
      But for my understanding could you please let me know whether my eligibility to work would depend on this amendment result? In other words would I still be able to work on my current Lead position based H1B if amendment doesn't gets through?

      I would greatly appreciate if you can shed some light on this.
