Hi,
I have a "what if" situation question.
My I-140, I-765, I-131 and AOS has been filed but my non-immigrant visa is expired.
In this case:
- can I continue to stay in US on this basis without EAD and no visa
- if not, and assuming I have returned to India, what happens to my Advance Parole (I-131) document that was filed with an assumption that I will be in US when the application gets approved? Can I come back to US after I get an EAD with the same I-131 or I have to apply a new one?
