  • GC/ I 140 question

    My husband is working with Company A on his H1 - now completed 4 years on H1. His green card has been initiated and his labour is through. His I 140 is being filed.

    He has got an admit in a B-School outside US for 1 year. We were exploring a few options and had the following questions:

    1. If he goes on a leave of absence from his current company to study, will his GC processing be affected?

    2. Assuming his H1 gets extended past the initial 6 years (because of his GC processing), is it possible to re-file his GC in case of a role change?

    3. After he comes back, his current role would change and his GC might need to be re-filed. In that case, can the priority dates be still maintained?
