  • GC and company lay-offs

    Hi,

Started my green card process (filing labor) in company A. Got labor approved and i-140 – Priority date Jan 2007 (EB2)
I changed my job in Oct 2008 to company B. Got labor approved and i-140, keeping my earlier priority date of Jan 2007.
For i-485, the EB2 date is now March 2007, so I can apply to i-485 in July 2011 (next month)

    Issue:
company B is closing the branch office where I work and we have an option to move to a new location (from CA to FL) or terminate job 12/31/2011.
I am not very keen to move but want to know the risks to my GC. This is my 7th year of H1B.
Since I have 6.5 months remaining in the current job, it that sufficient to get i485 approved?
What if there is an RFE? Since in this case company is terminating the job is there a requirement to stay in job for 3 months after i485 is approved?
Also, my 3 year extension will be filed in a week or so.

    Thanks!
