  • Changing employer afer I140 is approved.

    I am with Employer A. I am in 7th year. My priority date is 2008. My I140 is approved. I got my H1B extended till 2013.
    My questions are:

    1. If my present employer is not willing to give me my I140 approved letter, can I get copy of the letter without bothering about my present employer? If so, how can I apply for a copy?


    2. After moved to Employer B, if my date is current, can Employer B file I485 with out worrying about Employer A?

    3. Is it possible that Employer A can cancel my I140 approved?


    Please reply back, based on I will move to Employer B,

      Thanks to Freedom of Information/Privacy Act, you can get a copy of your approved I-140 through FOIA. google it for more details. here is the link i know:



      It may take some time to get it.

      The good news is you get to keep the PD. Yes, the first reply was right, your second employer has to go through the GC process all over again. When you file your 485, attach your copy of I-140.
