  • Fast moving priority date, please advise

    Hi,

I still have active I-140 (EB2) approval from my old employer with active h1b till Oct 2012 and then I changed my employer (Client).
I didn't even started GC process with new employer.

My priority date is Sept 2010. As the priority dates are moving very fast, I'm assuming my case will be current in a couple of months??

What would be the best way to take advantage of my I-140?? Can I move back to old employer for couple of months when my case becomes current?? If yes, how long I need to stick with the old employer?? Please advise me.

Yes, you can provided they have not revoked the H1b. You will need to stay with them till you get the GC or until you get a similar job as in your GC profile after 180 days of filing. Research AC21.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Thank you for pointing me in right direction.

      My last question is:
Can my old employer process the GC as a future employee? If yes, what will be the issues??
