EB2 vs EB3 based on Bachelors

Hi,

I want to know which category will I fall into- EB2 or EB3?

Education:

1. Bachelors (3yrs)
2. Diploma in computer (1yr)
3. MBA (2yrs)

Work experience is 6.5yrs excluding current employer who is filing GC. I have total experience in the same skill set that is required for job.

Job Description

Bachelors degree or US equivalent with 5yrs of work exp.

But my employers attorney is saying that my application will be filed under EB3 because my Bachelors degree is 3yrs whereas US bachelors degree is 4yrs.

Can we combine Bachelors (3yrs) and Diploma (1yr) to equivalent to US bachelors? Is it okay do that in GC application?

Your BS + Diploma + MS can be considered equivalent to at least U.S. BS.

In that case, you can qualify for EB2 under BS + 5 years of experience.

So, I guess this is what I need to do. I need to get education evaluation which will say my BS+DP+MS is equivalent to US Bachelors. That way, I will fit the criteria of Job description, correct?

One more question, does USCIS look for my Bachelors only when they receive application or they will see my education evaluation which will say my entire education is equivalent to US bachelors???
