  • Wife's interview date set for next month, just found out I was fired

    Hi everyone,

My wife's interview date has been set for next month in the Mumbai embassy location. Just found out I was downsized/fired. I'm not sure how this will effect the immigration process. She has to present the AOS at the time of interview according to the interview letter.

How do I proceed? I have enough savings to support her for as long as it takes to find new work and will also be eligible for unemployment benefits. Do I give her an updated AOS form with a new primary sponsor & i become the joint sponsor?

    This is a cr1 visa.

Any advice would be very much appreciated!

If at the time of affidavit signing, you were employed. You don't need to send a new AOS.

She will need an updated income tax return from you which is for year 2012 so as long as you have this ITR she'll be fine.

I'm confused, what do you mean by updated 2012 tax return? My original submission before the firing was going to include the 2012 1040 tax return.

Shouldn't I get a joint sponsor and revise my aos form to reflect my current income status and also list any other sources of income such as savings?

If you have previously submitted AOS & tax returns which do not include 2012 then you have to submit 2012 tax returns.
If you don't meet the poverty guidelines because of job loss then you have to find a joint sponsor who also has to fill up the AOS and submit supporting docs.
