  • Marriage certificate for parents for I-130 filing

    Hi,
    I am in the process of filing I-130/I-485 concurrently for my father. One of the items listed for filing I-130 for father is a marriage certificate. Both my parents are in the US and we can't get a marriage certificate from India without them being physically present there. What are my options here?

    1) Is there a "Non-availability of marriage certificate" form and who issues it?
    2) Can I get affidavits from his elder siblings who were present in the marriage and present it as evidence?
    3) Can I get a "Non-availability of marriage certificate" from the Indian consulate in the US.
    4) Can I submit a paternity test if the certificate is not available? It only establishes that my father is my biological father, but not that he was married to my mom at the time of my birth.
    5) Has anybody gotten their application accepted for their father without this certificate?

    Any help is highly appreciated.

      You really need your father's marriage certificate.

      Getting one from the consulate is not acceptable.

          Not really.

          Paternity test would only prove who your father is. It would not prove that your parents were married at the time of your birth.

          That essentially says that you would need to provide further evidence that father/son relationship actually existed and he supported you when you were child etc. A lot more complicated matter.

            Marriage Certificate

            Hi,
            I don't know exactly what the procedure in India however in Pakistan the marriage certificate is issued by the NADRA (National Database and Registration Authority). It is issued within a week time after analyzing other documents like Nikanama (Marriage Contract, National ID Cards etc.
