  • Whether to sponsor my parents this time or not!

    My parents got Visitor visa for 10 years on march 2004( after 4-5 rejections). My dad& mom came to US in May 2004. My dad left after 3 months but my mom stayed for less than 12 months ( filed for an extension of stay & got approved).
    I called my mom and she came to US again in March 2006, the officer at port of entry asked her why she stayed for one year in her last visit and put "NO EOS/NO AOS" on her I-94 and gave her 6 month stamp and told her "you should not extend your stay".

    Now my question is whether to call my dad and apply for green card for both of them this time or send my mom back and call them both after 6 months and then apply for GC. I know that GC processing is faster here than processing in India.

    I feel , that as a US citizen i have a right to sponsor my parents....

    Please let me know your opinions/experiences/suggestions.

    Ok so your parents are currently under a Visa current?

    then I would file in the United States for your parents (Parents should be in the U.S.), you must be 21 or older to apply for them tho.

      Yes, my mom is currently here.. But my dad is in india, I am planning to call him once i am ready for the paperwork... and yes, i am above 21 and a us citizen.

      Can i apply 130 and 485 together???

      Again one more issue i have is my mom& dad has no proper documentation, like their birth certificates or marriage certificate. Any body know if you can put any supplement documentation if we do not have these documents??

        You should file in india

        I filed for my folks last June and they have their interview in India next month. If you file while they are here, you have to do I 130 and I 485 as well and the I 485 takes time. However, filing from there will enable them to get their green card in 6 months. The reason mine took so long is because I waited for almost 4 months to get my 2005 tax returns done which caused a delay in filing my I 864 - affidavit of support.

          So, you filed in India only? but you should file I-130 here right?
          Can You please tell me the exact steps you did to get their GC???

          Currently, I came to know that they do not have Birth Certificates and marriage certificate which they have to get going to different villages which are not familiar of after they left those places since 25+ years..

          So, once they get those documents I will apply for their GC right away..
          So, please tell me the procedure in detail!
