  • I-130 filing for spouse and children under 18

As lawful permanent resident wish to file I-130 for spouse and children under 18 years. Is it to be filed separately or as one form treating kids as derivatives? Needs advise soon. Thanks

If you will become a US citizen in the next year or two, it might be better to file separate petitions, because once you become a citizen, your wife is in the Immediate Relative category which cannot have derivative beneficiaries.

Otherwise, just file one petition for your wife and let the kids immigrate as derivative beneficiaries; that saves money.

This is my personal opinion and is not to be construed as legal advice.
