  • am I going to violate the 90 days rule?

Hi all, I am on an F1 visa for the last 4 years. My partner and I plan to get married this January, after which I plan to apply for a green card and a temporary working permit that goes along with it. However, regardless of that we have also planned a trip abroad this December/January. So my plan is to come back, and a week after to get married, and soon after applying for marriage AOS filing 485, 130 etc.. will I be violating the 90 days rule? Thank you very much!!

You know you are getting married, so you are traveling abroad and then get back with a non-immigrant visa with the intention to get married and be a LPR. That's against what is expected.

I don't have experience to know for sure if you can/will get in trouble. Good luck.
