  • Petition my sister who has a 5 years old daughter

I'm a citizen and I would like to petition my sister who has a 5 years old daughter to come to the States. They are both Canadian. I don't know how long it is going to take, but looks like 15-20 years but we still want to try because we want to be together. It seems more difficult for her to get me to Canada, almost impossible.

My question is, if one day my sister granted her a green card, she has to come to the States right away and apply for a green card for her daughter? Can her daughter come without a green card? Or do they need to be out of the country every 6 months like a visa run?

    Please advise and thanks.

If she received the Green Card, her daughter will receive one too provide that she not 21 years old. Even if she becomes older than 21 year old, she might be able to make at 22, 23 or even 24. There is a calculator for people who age out in the system. First step, apply for her and put her daughter name in the application but it's gonna take sometime as you said.
