  • Baby born outside US (surrogate mother)

I'm an American citizen who was born in Peru

Lets say I have a baby with a surrogate mother in Peru, baby is born in Peru, what do I need to do to bring the baby to the US since I wont be married to her ?

Im a single guy who wants to have a baby, so my situation is different from couples. what do I need to do ?

I know that if u are a green card holder, you can bring the child with you to the US, as long as he has his passport (peruvian) and birth certificare and the baby will receive green card, but I have read that the baby will receive green card only if the mother is carrying the baby.

Im a US citizen and in that case, I have also read that I need to get the birth certificate from the baby, go to the American embassy here in the US and ask for an American passport for my baby, and then with that passport, go back to Peru and bring the baby with me .. is this possible ?

can i really get an American passport for the baby, as long as I have his or her birth certificate from Peru (in spanish) ? would i need to get the birth certificate translated ?

If i'm the father, then the baby automatically becomes an American citizen, regardless of the mother status, right ? and then I can ask for passport here, go back to Peru and bring the baby with me ? is this the best way to go about it ?

I understand that surrogate mother would be in Peru.

But who is the real mother, the biological mother?

Since the baby was not born here on the US soil, he/she will go through immigration process to get a US Certificate of Naturalization ( Form N-600). Get an lawyer, a situation like yours cannot be answered by people like us on the forum! I believe in on thing, the child will definitely get his/her citizenship if the DNA test prove that your are the father regardless mom status or where she lives! Hope that will help you. Good luck!
