on 60 days after OPT waiting on I-130 to be processed, if not recved should I depart?

I just finished my OPT, expired June 22nd, I have 60 days to depart whoever my spouse (US Citizen) filed I-130 on June 22nd. What will happen if my 60 days expire and we have not received the approval notice on I-130. Will I need to depart US or can I legally stay here and wait for the response?
