    My I-140 got approved on August 17th, 2015. PD November 2013. I have 1 year 3 months to complete 6 years of H1B (expiring Jan 2017). I am planning to change my current organization and I need your help before I agree to the new organization

    1. Will I be able to retain my priority date even if my current organization revoke my I-140? My new organization is planning to send me to a different country after 6 years of H1B for an year and will bring me back to US and file my perm.

    2. If I transfer my H1B will get approval for 3 years as I have I-140 or I will get approval till Jan 2017?

    3. Can my wife work even if my exiting employer revoke my I-140 and she has a valid EAD?

    Please help.

    I have partial answers.

    1. Yes, the PD of first i-140 petition is always considered

    2. I doubt you will get H1B extended for 3 years after h1 transfer, coz its linked with I-140 & employer.
