Hi, I am an EB-2 (ROW) applicant with the PERM LC just approved last week, with the status being current. My wife and I about to proceed with I-140 and I-485 (through my employer). My current visa status is H-1B, which began in 2012.
My wife is a teacher in Canada and has already accepted a full-time job offer beginning this September. Ultimately, we would like to avoid a period of unemployment for her, and further schooling for coming as F-1 is out of the picture.
If she obtains H-4 status, can we proceed to file I-140 and I-485 without her actually residing in the States until we get our green cards? Are there any specific steps of the process for which she would need to come to the States (biometrics, etc.)?
