My employer has received an RFE on my I-140 (employment based EB3 Skilled Worker). It is based on education stating that the benigiviaty does not qualify for the position. I have a two year diploma plus 20 years of experience, and Kellogg language was used in the approved PERM application. I?m attaching the USCIS info. Does anyone have experience of an approval after an RFE like this? We have been here for 7 years, on a TN then E-3 (I am dual Canadian/Australian citizen). We have almost adult children here with US partners and a denial will be devastating to our family. Any insight would be great.
