  • I-140 transfter after 6 months

    Hi ,


    I got my Labour approved and Applied I140. REcently i got my Receipt no for I-140.

    I heard from some other source that after 6 month of I-140 approval in the same company , one can change the job from the Employer A to Employer B? I am not sure whether it is correct or not. So can you pls suggest me as to whether i can transfter my I-140 with the current status to Employer B so that there will not be other procedure to start GC from the begining?

    What you heard is incorrect. If you change after I140, your new company has to start all over for the GC. Only thing that you can carry along with you is your Priority date provided the I140 is approved and you have the approval notice.

    Only if the 485 is filed and it has passed the 180 day mark, you can switch employers using AC21 if it is the same/similar job.
