My I-140 recently got approved in the EB1-OR category. My I-485 has not been filed yet. However, I just lost my job and have until end of September in my current company. I would get 2 months salary as severance. My H1-B is till 2013. Would I be out of status after my termination date? Is it possible to port my I-140 if I join a new employer? I understand that I can use this I-140 if I rejoin the same employer but I am more concerned about my status in the interim period. What are my options to maintain status in the US? Any detail on this is greatly appreciated.
