  • Applying for OCI for Minor

    Hello,

My daughter is currently residing in India with us and she was born in the US. Currently we have an Indian Passport for her but we will apply for her US passport soon. My question is can I apply for her OCI card after getting her US passport made while she is a resident in India? She has been a resident of India since May 2019 and holds a valid Indian Passport.

Also what is the process and when we apply for her US passport will we have to surrender her Indian passport? Her age is 4 years and 2 months.

Once you get the US passport, go here to surrender her Indian passport --> https://portal2.passportindia.gov.in...ine/procFormSc

Once you get the surrender certificate, go here to apply for OCI --> https://ociservices.gov.in/welcome

You will also need to find the regional FRRO office. The OCI website lists them. You can also google to find your regional FRRO. These information change and websites have new/additional information. Please check them again when you apply.

Currently, my daughter is on indian passport and residing in India. When we apply for her US passport then we need to surrender indian passport once she gets the US passport. My question is when we apply for her OCI with US passport (currently residing in India) then what will be her status until she gets the OCI card?

Is it okay to have the gap? Will it have any repercussions?

The OCI website says Foreign nationals cannot apply for OCI in India while on Tourist Visa, Missionary Visa and Mountaineering Visa. Moreover, the foreigner has to be ordinarily resident of India to be eligible to apply for OCI registration in India.
Note: 'ordinarily resident' will mean a person staying in a particular country or in India for a continuous period of 6 months.

Sorry, I don't have specific experience. You may contact your regional FRRO. Your daughter will be a foreign national as soon as she acquires a US passport. It is better to approach the FRRO office or hope someone with the same situation shares their experience.
