NIW/I-140/I-485 doubt

Hello Everyone,

I am planning to apply I-140 and I-485 concurrently under EB-2 NIW category in Aug2008. My lawyer said I should apply I-485 only when priority date is current but some of friends said I can apply both at a time. I am so confused , please help me?

There is no labor for NIW right? Where does PD come into picture?

NIW dont have priority date.I think lawyer meant the Visa status should be current. Can I apply both at a time?
