EB3 to Eb2 in the same company

My comp had started EB3.And its in 140 stage now.
Now they have realised that I was qualifying for EB2
process before joining this comp & they want to start the labor in Eb2 again.

Can it be possible ?Is there is any legal issues they/I
should know ?

If you start all over again and if you qualify, you can do it without problems.
