    Hi,
    I got my PERM approved, which i applied on Mar'2010.

    My H1B visa expires on dec'2010 & it is getting max-out on Oct'2011. So i'm applying for H1B extension. Can i go 1 year beyond my 6 years limit, as i got my PERM approved.

    I was told that i cant go for that option, as I applied to DOL only on Mar'2010 which is less than one year.

    Can anyone pls. clarify me?

    What id the max out date? If that is the 6 year date, your perm was applied and approved before completion of 6 years.

    If not, apply for I140 under premium, get approval and have a 3 year extension approved instead. That is an option.
