  • Change from F3 to F1

    Hello,

I have some questions and I'd like to ask for some guidance/answers/feedback, please?

I am approved for a F3 category green card visa. I am waiting for a visa number. It'll take another 2-3 years for the visa number to come through.

However, at the moment, I'm separated and am going through a divorce.

Will US CIS change the F3 category to F1 category? I mean, does 'unmarried' include 'divorced'? Will I need to wait until the divorce papers are formal?

What happens to the applications of my children, who were included in the F3 category, initially.

    Many Thanks!

Best to consult with an attorney i guess.

Yes, divorced is unmarried and would put you in F1 category. The divorce has to be final before you are legally unmarried. Children can be derivative beneficiaries of an unmarried person.

This is my personal opinion and is not to be construed as legal advice.
