  • H1-B Transfer India Travel

    Hello Experts,

    I need advise for traveling to india while H1-B transfer is in progress.Here is some more details.
    1. My employer(A) company is purchased by other company(B) and they are insisting for quekly apply for H1-B transfer.
    2. My Current employer's(A) visa is approved till July'2018.
    3. New Company(B) is planning to transfer H1-B in Sept'2017.
    3. Planning to travel to India OCT'2017.

    My Questions:
    1. Is it legal/advisable to travel while H1-B transfer is pending ?
    2. If yes, At which visa, Will be used Employer A's or B's,when I am traveling back ?
    3. What documents will be needed while tranfer of Visa ?
    4. Do I need to go to consulate for Visa Stamping ?
    5. Is there is any safe option for filing H1-B in my scenario like apply h1 with stamping in india ?
    6. As far as I know permimium processing is pused at this time by uscis.
    (a.)How long is expected time if my new employer (B) file a transfer on regular processing?
    (b.)Any expected time when premium processing will resume ?
    (c.) Will be able to able convert regular to premium processing when resumed ?

      1. Nothing illegal about it, but certainly not advisable.
      2. Visa is company independent even if company name is on the visa. But you would need B's approved petition.
      3. B's approved petition, receipt will not be enough.
      4. Not required, but you do need B's approved petition.
      5. Dont know what you mean by "safe option"
      6. a. 3-6 Months.
      6. b. No idea.
      6. c. Yes.

      Would not advise that you travel out without getting B's petition approval first.
