  • Interviews Mandatory for all EBs?

I submitted my I-485 at then end of July, gave fingerprints end of August. My case just got :

On September 21, 2017, we transferred your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number YYYY to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case.

Do we know if we are being subject to the fact that starting October 1st all employment based adjustments will be required to appear for an in-person interview?

That means an extra wait time of like a year

    Thanks!

Turns out it got Transferred to National Benefits Center if that means anything?

Yep most likely. My app was transferred to NBC Sept 13, scheduled for an interview on Sept 26, and my interview date is Oct 5th! I doubt it will be a year for you.

Thanks for reply, did you get your EAD or Advanced Parole before that?

Any news on your case? I got the same transfer notice a couple of weeks ago for my 485 case (based on EB-2 NIW). I also got my EAD right before being notified about the transfer of the case to the National Benefits Center.

        Thanks

No news yet. It has been 13 weeks since filing, 10 weeks since fingerprints and 4 weeks since transferring to the National Benefits Center.

How long did it take for your EAD to arrive?

Did you file in Texas or Nebraska service center? When was your package accepted? Mine was received July 31 at NSC and so far no news of transfer to NBC for interview scheduling.

Went for my interview on 12/1. No tricks.

Asked to confirm full name, address.

Asked the yes/no questions on I-485.

Asked to describe my job duties, where I received my PhD from, and a question about my military service in my home country.

Interviewing officer said he would approve my application at the end of our interview. Received GC and approval letter in mail on 12/11. Online status on USCIS website was never updated; still says interview scheduled for 12/1. He never checked any of my original documents.

My company's HR immigration specialist said affidavit of support only needed for marriage / family based applications, not employment-based ones.

What kind of documents do I need to take with me in the interview?

I have my Employment based I-485 interview scheduled for January 22.

I was just wandering about all the documents that I need to take for the interview. The receipt of notice calls out some of them. But most of them looks like they have already been submitted by my employer/attorney. Do I need to take these documents with me again even though it says in the receipt (unless already submitted)? Following are the checklist that I am confused about:

                    · A completed medical examination (Form I-693) and vaccination supplement in a sealed envelope (unless already submitted).

                    · A completed Affidavit(s) of Support (Form I-864) with all required evidence, including the following, for each of your sponsors (unless already submitted):

                    o Federal Income Tax returns and W-2’s, or certified IRS printouts, for the most recent tax year;

                    o Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 months;

o Evidence of your sponsor’s and/or co-sponsor’s Unites States Citizenship or Lawful Permanent Resident status.

                    · All documentation establishing your eligibility to Lawful Permanent Resident status.

                    · Original and copy of each supporting documents that you submitted with your application.

                    Thank you,
                    Aniruddha

                      - I-693 is the medical checkup form. If you did that and submitted that when you mailed your I-485 then you don't need it. If your I-693 was completed more than a year ago USCIS may RFE and ask you to go for another medical check so it is more up to date.

                      - I-864 is not needed for employment based interviews. This was confirmed by my company's HR immigration specialist.

                      - You should bring a copy of your W-2 for the most recent tax year (although my IO did not ask to check).

                      - You should bring a letter from your current employer, as well as the pay stubs. The main thing is the information should not contradict the pay stated in your I-140 (although my IO did not ask to check)..

                      - Evidence of sponsor's status is if your sponsor is an individual. SInce your's in employment based, your sponsor is a company, so you wouldn't need that.

                      - Original and copy of each supporting document you sent in. So this will mean items like Birth Cert, Passports, Visas, printout of i-94, etc, anything that you sent in (although my IO did not ask to check). The IO may want to verify the copies that you sent in by looking at the original.

What questions to expect from IO?

Thanks Jeff. I can finally be at ease with my documents now.

My Employment based Green Card is fully based on my work experience even though my education background might not necessarily match. Just wandering what kind of questions to expect from the IO?

The questions I had were to just confirm my full name and mailing address, the yes/no questions on form I-485 (just answer yes or no), provide brief explanations to the questions that I answered yes (due to my military training). I was asked to briefly describe my job duties, and where I received my PhD from.

                          Mine was EB-2.

Reading around the forums this seem to be the case for most EB2 interviews. If you're EB-1 I do wonder if there will be more scrutiny since you claim to be of extraordinary ability.

                            Nbc

Hi, I recently got a notice that my I-485 has been transferred from TSC to NSC and then the next day to NBC at Lee Summit, MO. I have been reading that this usually means that your interview is quite near. That can’t remotely be the case for me. Funnily, we never even received our biometrics appointment letter even though it’s been 81 days since filing (eb1a was approved in May). We raised an SR and also had an infopass appointment. The SR said that we will schedule your biometrics although haven’t heard anything yet for almost 4 weeks now. The person we met during the infopass appointment, a very nice lady but not an IO, checked our status with an IO and said that they have actually already started background checks so don’t worry, you aren’t getting delayed because of this. It’s indeed very strange. And yesterday I got this update that our case was transferred from NSC to NBC. Is this a cause for worry? I also read that sometimes cases being sent to NBC might mean months of waiting, if not years. Anybody has any advice/experience? Haven’t heard anything regarding EAD/AP.

                            Please help!

                              Hi there,

Congrats on your GC. I am having my interview in two weeks. One thing I want to check with you about what kind of questions they asked you regarding your military service in your country and what answer did you give ? Did you show them any documents related ?

May I also ask what country are you from?
