Applying OCI for my kid when my L1 visa is under extension

Hi - Im in USA, my current L1 visa is expired and L1 B extension is under processing(neither denied nor approved). My son is born in USA, I'm applying OCI for my child, CKGS requires legal status of parent document, for this can I submit my extension applied document with (USCIS #). One of my friend was advising to apply for Indian visa for my kid instead of OCI now as OCI may not be approved since my L1 extension petition is not approved yet. Incase of my L1 visa extension is denied, I have to go back to India with my kid, so is it advisable to apply India Visa or OCI for my kid. Also please share if I can legally apply for OCI from India for my kid he is entering to India thru Indian Visa.
