  • RFE (Request for evidence) - I485

    Hi,
    I received a letter from USCIS today requesting the below document(s)

    -> The beneficiary on form i-864, affidavit of support must submit a complete federal income tax return submitted to the IRS for the most recent tax year (2016).

    I am the beneficiary and I submitted my W2 as a supporting document with my I-864 (But i mentioned it wrong as 1099 in cover letter). I have couple questions,

    1) Is that about my W2 document or 1040 form? ( I submitted W2 with I-864 and not with I-485)

    2) Is it related to I-864 or I-485 ? ( I mentioned myself as the co-sponsor in I-864 and my wife is the sponsor )


    Please advice.

    wait the beneficiary has to submit too??????? OMG I am waiting for my REF now, I do not remember that I submitted mine.


    EDIT: Do you have kids? if you do then you as a beneficiary and co-sponsor you need to submit I864A.

    11/14/2017, I-765 status was changed to "New card is being produced".
    11/16/2017, I-765 status was changed to "Card was Mailed To Me".
    11/18/2017, Approval notices were received in mail for I-765 and 1-131. they would be valid for one year.
    11/20/2017, Combo card was delivered.
    09/06/2018, EAD renewal was received.
    09/17/2018, Fingerprint Review was completed.
    11/19/2018, Interview was scheduled.

      Thanks for the reply. Maybe because I am co-sponsor in I-864. No, I don't have any kids.

        I do not remember that I submitted my tax forms from 2015, 2016 and 2017. But for I-864, we did include my annual income. I have not received any RFEs. For the interview, we both will bring our pay stubs.

        Received texts/e-mails 6/6
        PD 6/5 & 6/6
        NOA between 6/8 and 6/12 (I was out of town)
        Biometrics letter in mail 6/17 w/ 6/28 date
        SR 9/2
        Contacted Congressman 10/1
        Called the Congressman's office 10/10
        Interview letter 10/10
        Approval Letters for I-765 and I-131 10/16
        Received EAD/AP card 10/17
        Interview 11/8 RFE after
        New Card Being Produced 11/16
        Conditional GC received 11/24

          I searched the instruction if the sponsor's income is over 125% poverty line I did not find anything that states beneficiary should submit any tax forms too. Thank god I was freaking out.

              Thank you. I did not expect it too. My wife did not work for 9 months in 2016 so I added myself as a co-sponsor since my income is higher than the required and we are living together from an year already. I think they are asking for 1040 since i already sent W2. I hope this RFE doesn't make the GC process late.
