  • Changing contract type with the same J1 visa

    Hi everyone,

I'm currently working as a postgraduate intern with a J1 visa in California.

The end date of my 12 month internship is set to April 2018, although the expiration date on my visa sticker is May 2022.
Unfortunately, the company is not able to extend my intern contract for more than 12 months due to internal limitation for internships.

I was wondering, since my visa would be valid for other 4 years, if the company can theoretically offer me another kind of contract available with the same J1 visa (e.g. trainee, specialist, research scholar etc.) maintaining my current J1 without going through the visa process again.

    Thank you

DOS & USCIS believe that the J-1 Exchange Visitor Program is intended strictly for temporary educational & cultural exchange activities, not for regular employment

Assuming you are not subject to HRR, your employer can easily petition a H-1B visa for you - likely exempt from the lottery process
