  • PERM process with same job different employer

    Hello,

I have my I-140 approved in 2012. I'm planning to change to a different employer, but with the same job role. I know I can port over the old priority date, but should the prem process be repeated again? I read somewhere, if the job role is same, there is no need to redo the PERM process with the new employer, how much of it is true?

    Thanks.

If you don't have an I-485 that has been pending for at least 180 days, then your new employer will need to redo the PERM and I-140. You should be able to keep your priority date.
