  • I-485 - Request for Initial Evidence

    Hello,

    I have received a Request for Initial Evidence from the UCISC for my i-485 application. This is the response from them:

    " - Submit all supporting tax documentation(w2,1099, form 2555, all supporting documents) submitted to the IRS for the most recent tax year
    The petitioner/sponsor must submit all supporting tax documents for the most recent tax year
    - Based on the documents submitted with form I-864, affidavit of support, for the petitioner/sponsor, the income did not meet 125% of the poverty guideline for the petitioner/sponsor's household size. "

    some background:
    - my wife(citizen) sponsored me and she has no income. We used my income as the household income and it is well above the 125% guideline. we are a household of 3
    - I submitted all my w2, 1099 for the year 2016 (just received w2 for year 2017)
    - I submitted 6 months of my salary slips
    - My Tax returns for the year 2016, 2015 and 2014
    - I have not filed my 2017 tax returns
    - we filed joint tax return for year 2016

    Questions:
    1. are they asking me to submit the latest w2?
    2. is it necessary that i should get some documentation from my employer for a proof of employment?
    3. should we just go ahead and get a co-sponsor ?
    4. I had entered latest yearly salary in the household income which is different from the 2016 w2, is this the cause of RFE?


    Please let me know what needs to be done

    if you need more clarification you can just call them and ask for an L2 officer. They can help you draft your response.
    I got a sort of similar RFIE, this was jan 2018 so i figured i just included my 2017 return, 2017 w2 and proof of employment to be sure.
    But when in doubt just inquire with them!

      There's a Federal Poverty Guideline calculator. Here's the link https://www.needymeds.org/FPL_Calculator
      Use that to determine if you really met the guideline. Usually, some people think that if they make a few thousand dollars more than the guideline, they qualify but they don't. If u don't meet the guideline I think a joint sponsor is the best option.
